Terms of Use
These Terms of Use govern access to and use of rushmoretravel.com, Rushmore Travel accounts, the Trip Planner, destination information, offers, communications and related services (collectively, the “Services”). By using the Services or creating an account, you agree to these Terms and acknowledge the Privacy Policy below.
Using Rushmore Travel
You may use the Services for lawful personal travel planning and other purposes we expressly permit. You agree not to misuse the Services, interfere with their operation, attempt unauthorized access, scrape or harvest information in a manner that burdens the Services, impersonate another person, submit false or unlawful material, or use the Services to violate another person’s rights.
Accounts and security
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials and promptly notifying Rushmore Travel if you believe your account has been compromised. If you are under the age of majority where you live, you should use the Services only with the involvement of a parent or legal guardian. The Services are not directed to children under 13.
Trip Planner and saved information
The Trip Planner is a planning convenience. Saved destinations, dates, businesses, notes and preferences do not create a reservation, booking, guarantee, contract or availability commitment with Rushmore Travel or a listed business unless a separate transaction expressly says otherwise.
Travel information and third-party businesses
Rushmore Travel may feature hotels, casinos, lodging providers, restaurants, retailers, attractions, tour operators, events and other independent businesses. Listings, schedules, prices, hours, availability, road conditions, policies and other travel information can change. You should confirm important details directly with the relevant provider before traveling or purchasing. Participating businesses remain responsible for their own products, services, transactions, representations and customer service.
Links, offers and transactions
The Services may link to websites, booking systems, advertisements or services operated by third parties. Rushmore Travel does not control those third-party services. A transaction you enter into with another business is governed by that business’s terms and policies in addition to any terms that expressly apply through Rushmore Travel.
Intellectual property
Except for third-party materials identified through attribution or other notices, the Rushmore Travel name, site design, original text, graphics, software, organization and other original content are owned by or licensed to Rushmore Travel and are protected by applicable intellectual-property laws. You may use the site for personal travel planning but may not reproduce, republish or commercially exploit protected content without permission.
Service changes and account action
We may update, suspend or discontinue features, and may restrict or terminate access when reasonably necessary to protect users, partners, Rushmore Travel or the integrity of the Services, including for violations of these Terms.
Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as available” basis. Rushmore Travel does not guarantee that every listing, itinerary, recommendation, third-party offer or other piece of information will always be complete, current, available or error-free. Nothing on the site is a guarantee of travel conditions, safety, availability or a particular result.
Limitation of liability
To the fullest extent permitted by applicable law, Rushmore Travel will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Services or from the acts, omissions, products or services of independent third parties. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
Governing law
These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any dispute will be handled in an appropriate court with jurisdiction unless the parties separately agree to another lawful resolution process.

This Privacy Policy explains how Rushmore Travel collects, uses, discloses and protects information when you visit rushmoretravel.com, create an account, use the Trip Planner, subscribe to communications, interact with advertisements or otherwise use the Services.
Information we collect
- Account information: such as name, email address, authentication information and account preferences.
- Trip and interest information: saved destinations, lodging, dining, attractions, businesses, dates, categories, preferences and other information you add to a trip or provide to us.
- Communications: information you provide when contacting us, entering a promotion, requesting information or communicating with a participating business through the Services.
- Device and usage information: such as IP address, browser or device characteristics, pages viewed, referring pages, interactions, approximate location derived from IP address and similar analytics or security data.
- Cookies and similar technologies: information described in the Cookie Policy below.
How we use information
We may use information to provide and maintain accounts and Trip Planner features; personalize travel content and recommendations; respond to requests; measure site performance; protect against fraud or abuse; improve Rushmore Travel; provide advertising, offers and marketing; connect travelers with relevant participating businesses; comply with law; and carry out other purposes disclosed when information is collected.
Participating tourism and business partners
Rushmore Travel is designed to connect travelers with businesses relevant to their plans and interests. We may disclose or make information available to participating or affiliated tourism and business partners—including hotels, casinos, lodging providers, restaurants, retailers, attractions, tour operators, event providers and similar businesses—for lead generation, traveler services, relevant offers, advertising, marketing, analytics and other purposes described in this Policy.
For example, if your trip information indicates an interest in lodging in Deadwood, Rushmore Travel may use that information to help connect you with participating lodging businesses or relevant offers. A participating business may compensate Rushmore Travel for advertising, marketing services, qualified leads or other commercial opportunities.
Rushmore Travel does not operate as a data broker and does not sell customer lists to unrelated data brokers. Some privacy laws define “sale,” “sharing” or targeted advertising broadly enough that certain partner advertising, lead-generation or data disclosures may fall within those definitions even when no customer list is sold to a data broker. Where an applicable law gives you a right to opt out or otherwise control that activity, Rushmore Travel will honor that right as required by law.
Other disclosures
We may also disclose information to vendors and service providers that help operate the Services; when necessary to protect users, partners, our rights or the security of the Services; in connection with a business transaction such as a merger, financing or acquisition; or when required or permitted by law. Service providers are expected to use information for the services they provide to us and consistent with applicable obligations.
Advertising and analytics
Rushmore Travel may use analytics and advertising technologies to understand site use, measure campaigns, personalize content and advertising, and help participating businesses reach travelers likely to be interested in their offerings. Where applicable law requires consent or an opt-out mechanism for particular technologies or uses, we will provide the required choice.
Data retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including providing the Services, maintaining records, resolving disputes, enforcing agreements, meeting legal obligations and protecting the Services. Retention periods may vary by the type of information and its purpose.
Data security
We use reasonable administrative, technical and physical safeguards appropriate to the nature of the information we maintain. No website, transmission or storage system can be guaranteed to be completely secure. If a security incident triggers legally required notification, Rushmore Travel will provide notice in accordance with applicable law.
Your privacy choices and rights
You may update certain account information and communication preferences through available account controls. Depending on where you live and which privacy law applies to Rushmore Travel, you may also have rights to request access, correction, deletion or portability of certain personal information, or to opt out of certain sales, sharing, targeted advertising or profiling. We may need to verify a request before acting on it, and lawful exceptions may apply.
Rushmore Travel will provide and honor additional privacy-choice mechanisms, including applicable universal opt-out signals, when required by law. Exercising an applicable privacy right will not change the enforceability of the other portions of these Terms.
Children’s privacy
Rushmore Travel is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through account registration. If we learn that such information was collected, we will take appropriate steps to delete it.
United States operations
Rushmore Travel is based in South Dakota and the Services are operated for a United States audience. Privacy rights can vary by state. We apply the rights and obligations required by laws that are applicable to Rushmore Travel and the individual making the request.
Advertising Disclosure
Advertising & Sponsored Content
Rushmore Travel is a commercial travel and marketing platform. Businesses may pay for advertising, enhanced visibility, sponsored placements, marketing services, lead generation or other promotional opportunities. Sponsored or paid content will be identified where disclosure is appropriate so visitors can distinguish advertising from independent editorial content.
Compensation may affect where or how a participating business appears, but it does not change that the business is responsible for its own products, services, prices, claims and customer relationships.

Rushmore Travel respects intellectual-property rights. Original Rushmore Travel content may not be copied or commercially reused except as allowed by law or with permission. Third-party names, trademarks and logos belong to their respective owners. Photography and other licensed materials remain subject to their applicable licenses.

Changes to These Terms & Policies
We may revise these Terms and policies as Rushmore Travel evolves or legal requirements change. The effective date and version will be updated when revisions are published. When a material change requires additional notice or renewed consent under applicable law, we will provide it. Continued use after an effective update constitutes acceptance to the extent permitted by law.
